Bhopal Gas Tragedy - Mockery of Indian judiciary
More than 25 years after the toxic gas leak from Union Carbide's plant in Bhopal killed an estimated 25,000 people & the toll of victims is still rising, the survivors were disappointed after a court held eight officials guilty of criminal negligence in the world's worst industrial disaster. Yesterday the Magistrate court in Bhopal convicted all eight Indians accused in the 1984 Bhopal gas tragedy case. Their punishment: two years imprisonment and an Rs 1 lakh fine. All of them were granted bail. Also, a Rs 500,000 fine was imposed on Union Carbide India Ltd (UCIL) from whose pesticide plant tonnes of lethal methyl isocyanate gas leaked on the night of Dec 2-3, 1984, killing thousands instantly and many more over the years. People are still suffering. The officials held guilty are the then UCIL chief Keshub Mahindra, Vijay Gokhale, J Mukund, S P Chaudhary, K V Shetty, Kishor Kamdar and S I Quireshee who didn't appear in court due to ill health. Another accused, R B Chaudhary, died during the trial. People responsible for the massacre of over twenty three thousand people and affecting the generations that follow get just two years of imprisonment after a long 26 years of trial & that, too, only to be let out on bail. Despite yesterday's conviction, there is little closure for victims. Legal experts have alleged that there was an attempt to cover up the case. It took the CBI three long years to file a charge sheet that many believed was weak. Then in 1996 the charges were watered down making all sections carry the maximum punishment of 2 years. Every possible opportunity was given to culprits. The charges were also all bailable and with the prime accused in the case, former Union Carbide (USA) chairman Warren Anderson still on the run and unlikely to present himself in Indian court, there is little hope that justice will be served. If this was the decision why they waited for 26 years? Hope anyone can answer. It is a black day for Bhopal gas victims; the judgment has made a mockery of the sufferings of the people of Bhopal. It is really pitiable that it takes over 25years to take action on culprits. The Indian judiciary and government should hang their head in shame. The only thing I can say is this is a very good example of law taking its own course but after 26 years. Our Indian judicial system should be awarded for breaking the snail's speed record. I do not know whether this is because of corruption or because of fundamental flaws in the system itself. I will not be wrong to say that our judicial system is inefficient and ineffective. It needs to be revamped thoroughly. Judiciary is to me made accountable as any other system is. When the judicial system failed to hang the culprits, its very sad to know that the Bhopal Gas disaster victims will be hanging nearly 64 effigies of the accused, including that of Warren Anderson, the then chairman of Union Carbide Corporation, USA.They are preparing the effigies with their meager resources and the victims said, hanging them gives them some peace of mind. This is a grave miscarriage of justice. Twenty-six years and still there is no proper settlement in sight. What one can say about the efficiency and the promptness of our judicial system? Sometimes I feel that our country is heading towards failed state. No one owns the responsibility of any task given. I honestly feel Justice is snatched from the common man. Justice delayed is justice denied which is true beyond doubt in this case of unparallel human tragedy. Comments (14) sade wrote on 09 June, 2010
Now i always take the reports of the sensation mongering scavengers of our electronic news media with a pinch of salt, but if it turns out that Warren Anderson was truly allowed to flee on bail in the then chief ministers own designated plane, then the said chief minister is a pimp who has slept with his ***er and sold her several times over:
if it turns out, as the media reports and the ex-CBI officer's interview suggest, that the then Ministry of External affairs had indeed asked the CBI not to pursue the matter of Warren Anderson's extradition, then that minister and the CBI officials who abdicated their office, for all practical purposes are again pimps who have slept with their ***ers several times over and then sold her. If it turns out that the judges involved had deliberately ignored the self-evident naked truth, and the spirit of the Law, and instead taken refuge in the letter of the law and the loop-holes inherent therein, for a bribe or vested interest, then those judges.... sade wrote on 09 June, 2010
It is not a question of just corruption, or political and foreign policy contingencies, lives are involved here, thousands of lives, instantly destroyed , and lacs still suffering. This public display of indignation, and expletives are the only recourse available to the common man, rendered impotent by the government machinery and his own quest of "do waqt ki roti".

I think our politicians are to be blamed.

The politicians only act when they are attacked, public life in India is cheap, I think Dr. Kalam should declare that his 2020 dream will never be achieved because of our corrupt politicians.
I was reading an interview somewhere with the current boss of CBI, when asked about torture commonly used by police he really had no answer, he gave some lame excuse to look from policeman's view point, police in India serves their political masters, they are feared by common man more than criminals and no political party is interested to clean up the police force. The CBI boss should take moral lesson from Gen Fonseka who said in an interview to BBC that he will reveal all if there is an independent inquiry that how Sri Lankan political masters ordered to kill the surrendering LTTE top brass in the last stage of war, now the Sri Lankan defense secretary has threatened to execute Fonseka for treason. Just contrast this courageous answer with that of our federal police boss. maaz_nawaz wrote on 09 June, 2010

MAAZ_NAWAZ @ by now you should know that i call it as i see it, your responses to the comments on your blogs lead me to suspect that you are only being polite, not only that, but that you are not entirely committed to the issues in your blogs, but do so only to score brownie points. I apologize if i offend you, and more so, if i am wrong, but then you know me--i am the alcoholic with the foot in mouth disease.

Soon all the mud stirred by the media will settle down after they have milked all the TRP possible from it, (like the Ruchika story, the Koda Scam, the Satyam scam, the Nanavati commission report, the Sri Krishna report, the list is endless), this story too will fade from public memory and we shall continue with our lives as before--like so many @#$%& sheep--has anybody ever been held accountable or punished? Rathod too will be out on bail, it's only a matter of time
